1. Provider Eligibility

Providers must be:

• Registered as legal business entities.
• Fully licensed to operate water-sport tours, where required by applicable law.
• Insured according to applicable local and national regulations.
• Compliant with relevant safety, maritime, and adventure-tourism laws and regulations.

2. Provider Responsibilities

Providers are solely responsible for:

• Customer safety during their activities.
• Equipment maintenance and safety.
• Staff qualifications, training, and certifications.
• Compliance with applicable local, national, and international laws.
• Accident management and emergency procedures.
• Tour quality, scheduling, and the accuracy of listing information.
• Providing the services advertised and confirmed at the time of booking.

Paddle Quest LLC operates PaddleBooking.com as a marketplace connecting customers with Providers. Unless expressly agreed otherwise in writing or required by applicable law, Paddle Quest LLC does not operate the tours and does not assume responsibility for the Provider’s day-to-day operations.

3. Pricing Rules

Providers must:

• List prices on PaddleBooking.com that are consistent with the prices offered on their own websites or through their direct sales channels.
• Include all mandatory fees and taxes in the displayed price or clearly disclose them before booking, as required by applicable law.
• Honor the listed price once a booking has been confirmed.
• Ensure that all pricing, availability, and additional charges are accurate and transparent.

4. Commission & Fees

Paddle Quest LLC charges a standard commission of 15% of the total tour price for bookings made through PaddleBooking.com.

The Provider’s payout is calculated as follows:

Tour Price – 15% Commission – Applicable Transaction Fees = Provider Payout

Applicable transaction fees, including payment processing fees charged by Stripe or other payment processors, are deducted where applicable.

Providers are paid in accordance with the applicable payout procedures following completion of the tour.

For bookings processed through partner booking systems or marketplaces, including FareHarbor and Bokun, the applicable commission rates, fees, and payout arrangements are governed by the relevant agreement with the respective partner.

5. Payment Terms

Customers must pay the full tour price at the time of booking through PaddleBooking.com or the applicable partner booking system or marketplace.

For bookings processed directly through PaddleBooking.com, payments are handled through the applicable payment processor and are subject to its procedures and terms.

Provider payouts are calculated after deducting PaddleBooking.com’s 15% commission and applicable transaction fees.

For bookings processed through FareHarbor, Bokun, or other partner platforms, payment collection, commission deductions, transaction fees, and payouts are handled according to the applicable partner agreement and procedures.

Paddle Quest LLC is not responsible for payment processing or payout arrangements controlled by a third-party partner, except where expressly agreed in writing or required by applicable law.

6. Provider Cancellation Policy

If a Provider cancels a confirmed tour booked directly through PaddleBooking.com:

• The Customer is entitled to a full refund of the amount paid through PaddleBooking.com, in accordance with the applicable Cancellation & Refund Policy.
• The Provider is responsible for applicable transaction fees associated with the canceled booking, where applicable.
• No cancellation penalty or transaction fees will be charged to the Provider when the cancellation is caused by severe weather or other qualifying force majeure circumstances, subject to the applicable Cancellation & Refund Policy.

For bookings made through FareHarbor, Bokun, or other partner platforms, the applicable partner’s cancellation and refund policies and procedures apply.

7. Conduct & Compliance

PaddleBooking.com reserves the right to suspend or remove a Provider or listing if the Provider:

• Violates applicable safety requirements.
• Receives repeated substantiated customer complaints.
• Provides fraudulent, inaccurate, or misleading information.
• Fails to comply with applicable laws or regulations.
• Endangers customers or other individuals.
• Otherwise materially violates these Provider Terms & Conditions.

8. Indemnification

To the extent permitted by applicable law, the Provider agrees to indemnify and hold harmless Paddle Quest LLC from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from or related to the Provider’s services, negligence, misconduct, breach of these Terms & Conditions, or violation of applicable laws.

This provision does not exclude or limit any liability that cannot legally be excluded or limited.
