Cancellation Policy
CANCELLATION & RESERVATION POLICY
**Purpose**
Our goal is to provide a clear, fair, and transparent process for managing reservations, cancellations, and changes. We strive to ensure guest safety and satisfaction while maintaining efficient operations and respecting the policies of vessel operators and maritime authorities.
**Cancellation Due to Weather, Safety, or Operational Conditions**
If weather, maritime conditions, mechanical readiness, port restrictions, or other safety concerns make the charter unsafe or impractical, we reserve the right to cancel, postpone, or modify the reservation.
Safety determinations are made solely at the discretion of:
- The vessel captain
- The Port Captain (Capitanía de Puerto) of the departure port
- The vessel operator or charter coordinator
These determinations may be based on marine forecasts, port authority guidance, operational considerations, vessel readiness, or real-time conditions.
If a charter is canceled for these reasons, guests may:
- Reschedule to a future available date, or
- Receive a full refund of amounts paid.
We are not responsible for incidental or consequential expenses such as transportation, lodging, or other travel-related costs.
**Cancellation by the Customer**
7 days or more before the scheduled charter
- Full refund minus applicable processing and administrative fees.
Less than 7 days before the charter (including no-shows)
- No refunds will be issued.
- The full reservation amount is non-refundable.
Failure to arrive at the scheduled departure time without prior written notice will be treated as a last-minute cancellation.
*Important Notice Regarding Cancellations*
All cancellations or change requests must be submitted in writing via our official booking email, messaging contact, or reservation platform. The date received determines the applicable cancellation timeframe.
Processing fees may include, but are not limited to:
- Credit card or payment processor fees
- Booking platform commissions
- Currency conversion charges
- Administrative handling costs
These may vary depending on payment method and booking channel.
**Reservation Changes & Vessel Substitutions**
We will make reasonable efforts to accommodate reservation changes whenever possible. However, due to industry-wide cancellation policies implemented by vessel operators:
- Requests to switch vessels or substantially modify a booking may be treated as a cancellation and new reservation.
- Deposits paid are often non-refundable within 30 days of departure and may therefore remain non-refundable to the client.
- Additional costs, rate adjustments, or administrative fees may apply.
While we always aim to assist when feasible, changes cannot be guaranteed once vessel operator cancellation windows apply.
**Force Majeure / External Conditions**
We are not liable for indirect or consequential costs resulting from circumstances beyond our control, including but not limited to:
- Government restrictions or regulatory actions
- Port closures or maritime authority directives
- Mechanical or technical issues affecting safe operation
- Natural disasters or environmental hazards
- Safety determinations by the captain or port authorities
This clause limits liability for additional guest expenses but does not eliminate the remedies described in this policy.
**Exceptions**
Requests due to emergencies or extraordinary circumstances may be considered on a case-by-case basis.
Any exception granted:
- Is solely at our discretion
- Does not waive this policy
- Does not establish precedent for future bookings
**Policy Acceptance**
By confirming a reservation or submitting payment, the client acknowledges acceptance of this cancellation and reservation policy, which forms part of the booking agreement.
